Terms and Conditions for Track Engine
Last updated: 9 October 2026
Provider
The provider is Dipl.-Ing. aer Mark Erik Prinz, trading as Software Vertrieb Prinz (sole proprietorship), Hermann-Löns-Straße 6c, 63322 Rödermark, Germany. Contact: support@trackengine.de, telephone: +49 170 7640655.
Scope of services
Track Engine is a browser-based online application for slot-car track planning, race control, a racing database, series and events, and Driver Displays. The subscribed plan and the product description at the time the contract is concluded determine the available features and limits. Hardware features require compatible hardware.
Account and requirements for use
A user account is required for cloud-based features, subscriptions and shared Workspaces. Only persons aged 18 or over may conclude paid contracts. Minors may use Track Engine through an account and contract held by a parent or legal representative. Users must protect their login credentials. Anyone concluding a contract for a business, association or other organisation must be authorised to represent it.
Free, Basic, Plus and Pro plans
Track Engine offers the free Free plan and the paid Basic, Plus and PRO plans. The plans differ, among other things, in saved layouts, track pieces, members, devices, simultaneous use and racing features. The service characteristics agreed when the contract is concluded are binding.
Commercial use
Commercial use means using Track Engine in connection with a self-employed professional, business or other activity performed for remuneration, or to provide paid services to third parties. This includes, in particular, event agencies, commercial racetrack or event operators, paid services for customers, and commercial rental or operation.
Commercial use requires an active PRO subscription. Free, Basic and Plus do not permit commercial use. PRO may also be used for private and non-commercial purposes.
Internal use by a non-commercial association for its members is not commercial merely for that reason. Membership fees or occasional participation fees that cover costs do not, by themselves, make the use commercial.
Conclusion of the contract
The presentation of plans is an invitation to place an order. By placing an order with an obligation to pay, you make an offer for the displayed plan. We accept the offer as soon as the payment service provider confirms to us that payment was successful. We then send you, without undue delay, a contract confirmation containing the agreed contractual terms, the withdrawal instruction and the model withdrawal form to the email address provided when placing the order. Paid features are activated once we have sent this contract confirmation. The relevant time of conclusion of the contract is the purchase time specified in that confirmation, which records when successful completion of the payment process was confirmed. Failed or pending payments do not result in activation of paid features.
Recurring subscriptions and billing
Monthly subscriptions are concluded for an indefinite term and billed monthly. Ordinary termination takes effect no later than the end of the current monthly billing period.
An annual subscription has an initial minimum term of twelve months. The stated annual price is charged for this initial term. Ordinary termination may already be notified during the minimum term and takes effect at the end of that term.
The contract then continues for an indefinite term and is billed monthly. Ordinary termination then takes effect no later than the end of the current monthly billing period. No new fixed twelve-month term begins. The monthly continuation price stated and agreed when the contract was concluded applies; a later catalogue price does not automatically replace it.
Plan changes and termination
An upgrade takes effect immediately. It does not start a new twelve-month minimum term; the original end of the initial term is preserved. The displayed upgrade billing and the monthly continuation price of the higher plan are disclosed and agreed before the change. A scheduled downgrade takes effect at the stated end of the term. After a plan change or termination, the features and limits of the plan that subsequently takes effect apply.
You can notify ordinary termination using “Cancel contracts here”. The feature shows receipt of your notice and sends an acknowledgement. Statutory rights to extraordinary termination remain unaffected.
Stripe payment processing
Payments and billing management are handled through Stripe. Track Engine receives the billing information required to manage contracts and entitlements. Full card numbers are not processed in Track Engine's browser code.
Workspaces, members and limits
A Workspace is the shared Track Engine area for layouts, segments, drivers, vehicles and tracks. Authorised members can use shared content. They use the features and limits of the Workspace owner's plan. Account and billing data remain assigned to the respective user or authorised owner. The stated limits for saved layouts, track pieces, members, devices and simultaneous use apply.
Community content and publication
Publication is voluntary. You retain the rights to your content and must hold the rights required for publication. You grant Track Engine non-exclusive, royalty-free rights to store, display and technically reproduce the content to the extent necessary to provide the published content within Track Engine. This does not transfer ownership of your content.
Other users may view, copy and use published content within Track Engine. Removing a publication ends its future public availability. Copies already created by other users are not automatically deleted as a result; they may continue to be used within Track Engine. Independent third-party rights and statutory claims remain unaffected.
Track Engine may review content where there are concrete indications of infringements, abuse, security risks or breaches of these terms and, where necessary, block or remove it. Measures are limited to what is necessary; affected persons are informed of the reason unless legal or security grounds prevent this. You can send reports and objections to support@trackengine.de.
Your own content
You must be entitled to use uploaded or created content and respect third-party rights. Track Engine uses private content only to the extent necessary to provide the features you have selected. Publication takes place only through the features provided for that purpose.
Availability, maintenance and changes to the service
Maintenance, security measures, technical faults and failures of external services may temporarily restrict use. Statutory claims remain unaffected.
Changes going beyond measures necessary to maintain conformity with the contract are made only for a valid reason: adaptation to changed legal requirements, remedying specific security risks, or adaptation to changed technical interfaces, to the extent necessary to continue providing the agreed features. Such changes do not result in additional costs for you. We inform you clearly and comprehensibly about the change. This does not permit arbitrary material deterioration of subscribed services.
If a change impairs access or usability to more than a minor extent, we inform you sufficiently in advance on a durable medium, for example by email, about the characteristics and timing of the change and your right to terminate the contract free of charge. You may terminate the contract free of charge within 30 days of receiving that information or, if the change occurs later, within 30 days of the change. Statutory exceptions, in particular continued provision without changes and without additional costs, remain unaffected. Silence does not constitute consent. This provision does not permit a unilateral increase in the agreed continuation price.
Withdrawal
Consumers have the statutory right of withdrawal described in the withdrawal instruction. Under Track Engine's rules, immediate access or use does not cause this right to expire early. Track Engine claims neither compensation for the value of software use before an effective withdrawal nor a pro-rata usage fee. No amount is retained solely because of use.
Liability and statutory rights
The statutory provisions apply.
